1. Copyright and Usage Rights

• Copyright Ownership: 

  Photographers typically retain the copyright to their images under the Copyright, Designs and Patents Act. 

• Usage License: 

  The client is granted a license to use the images, but the specifics vary. 
  • Personal Use: The client can use the images for personal use (e.g., printing, sharing with family). 
  • Commercial Use: Commercial use (e.g., selling photos, using them for advertising) is usually restricted unless specifically agreed upon. 
  • Exclusivity: A period of exclusivity might be granted to the client, after which the photographer can also use the images. 

2. Photographer's Creative Control 

• Artistic License: 

  The photographer often retains complete artistic license over the style, poses, and composition of the photographs.

• Final Decision: 

  The photographer's decisions are generally final, and the client cannot reject material based on style or composition.

3. Liability and Limitations

• Unforeseen Circumstances: 

  The photographer is not liable for issues like bad weather, poor lighting, or technical failures (camera malfunctions, lost files) that affect the quality of the service. 

• Failure to Perform: 

  In cases of photographer illness or other uncontrollable events, the photographer's liability may be limited to the total value of the contract. 

• Safety: 

  Clients are often responsible for their and their children's safety during a photoshoot and must remain vigilant near equipment or props. 

4. Image Files 

• Unedited/RAW Files: Clients typically do not receive unedited or RAW image files, as the copyright holder (the photographer) maintains control over them. The client can request these which will be down to the photographers discretion to release them.

5. Conduct and Cooperation

• Client Behaviour: 

  Photographers reserve the right to terminate coverage if they experience threatening or inappropriate behaviour from anyone at the event. 

• Third-Party Photography: 

  Clients may be prohibited from taking their own pictures with phones or cameras during a professional shoot. 

6. Cancellations and Postponements 

• Written Notice: Cancellations or postponements must be made in writing. 
• Fees: The shoot is determined to have started when the photographer has arrived on-site; Full payment to the agreed rate will be liable. Prior to the shoot (within 24hrs); The client is liable for 50% of the shoot rate and all expenses and costs incurred relating to the shoot. Prior to the shoot (over 24hrs); The client is liable for all expenses and costs incurred relating to the shoot.

7. Payment 

• Payment Terms: The terms of the contract will be determined prior to the start of the contract by either a session rate or package rate. Session rates are determined by per hour, per day, per event. Extra costs and expenses in connection to the shoot are charged additionally and itemised in the final bill. Package rates are for the agreed shoot including expenses. Any additional work and costs relating to additional work over the agreed shoot will be charged and itemised in the final bill.
